1. Service Overview

The Curbman provides scheduled trash bin curbside services, including placing trash, recycling, and green waste bins at the curb on trash day and returning them after pickup.

2. Service Schedule

Services are performed based on the customer’s municipal waste collection schedule.

Bins are placed at the curb the evening before or the morning of pickup, and returned by the following evening.

Customers must ensure bin access is unobstructed and gates are unlocked on service days.

3. Service Plans & Payments

Monthly service plans are prepaid and auto-renew unless canceled in accordance with Section 5.

Payments are processed via the card on file and are due in advance of each month’s service.

Non-payment may result in immediate suspension or termination of service.

4. Customer Responsibilities

Bins must be labeled or easily identifiable for service.

The path to the bins must be safe, free from obstructions, and reasonably maintained.

Pets must be secured on service days.

Customer must notify The Curbman of any service interruptions (e.g., no trash that week).

5. Missed Service & Cancellations

A minimum of 24 hours’ notice is required to skip a scheduled service.

Cancellations must be made at least 7 days prior to the next billing cycle to avoid being charged.

Missed services due to locked gates, obstructions, or inaccessible bins may still be billed.

6. Refund Policy

Refunds are not issued for partial months or unused visits.

If The Curbman fails to provide service without cause, a prorated credit or refund may be issued upon request.

7. Waiver of Liability

By using The Curbman, the customer acknowledges and agrees that:

- The Curbman is not responsible for damage to bins, landscaping, driveways, fences, or property arising from:

- Normal wear and tear

- Improper bin maintenance

- Pre-existing conditions

- Obstructions or unsafe access paths

- Customer releases The Curbman, its employees, and agents from any liability for injury, loss, or damage arising from or related to the services performed, except in cases of proven gross negligence or willful misconduct.

8. Dispute Resolution

Any disputes or claims related to these Terms shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.

Both parties waive the right to a jury trial and agree to resolve disputes on an individual basis only (no class actions).

9. Modifications

The Curbman may update these Terms at any time. Changes will be posted on our website and become effective immediately upon posting.

10. Governing Law

These Terms & Conditions are governed by and interpreted under the laws of the State of California.
